Puzzly Terms and Conditions

These Terms and Conditions (the “Terms”) govern your download, access to, and use of the Puzzly mobile application (the “App”). The App is operated by Waraira Tek LLC (“Puzzly,” “we,” “us,” or “our”).

By downloading, accessing, purchasing through, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be legally capable of agreeing to these Terms in your country. If you are not, a parent or legal guardian must review and accept these Terms for you and supervise your use of the App. You must also comply with the terms that apply to your Apple Account and device.

2. The App

Puzzly provides a collection of daily word, number, spatial, and logic puzzles. Features may include daily puzzles, an archive, local statistics, advertisements, optional feedback tools, sharing, subscriptions or other premium access, and Apple Game Center leaderboards.

We may add, change, suspend, or discontinue features or content. We do not guarantee that a particular puzzle, season, archive item, leaderboard, advertisement, or feature will always remain available. If a change affects a paid service, your mandatory rights under applicable law remain unaffected.

3. License and acceptable use

Subject to these Terms and the applicable App Store rules, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the App on Apple-branded devices that you own or control.

You may not:

• copy, distribute, sell, rent, sublicense, or commercially exploit the App or its content;
• reverse engineer, decompile, modify, or create derivative works of the App except where applicable law expressly permits it;
• bypass subscriptions, advertising, archive locks, security controls, or other access restrictions;
• use automation, exploits, altered clients, false results, or other unfair methods to manipulate puzzles, scores, or leaderboards;
• interfere with the App, its networks, or another person’s use of the App;
• use the App for unlawful, fraudulent, abusive, or infringing purposes; or
• submit feedback or other content that is illegal, harmful, deceptive, infringing, or contains another person’s personal information without permission.

4. Puzzly Pro and in-app purchases

The App may offer Puzzly Pro or other in-app purchases. The exact product, billing period, price, currency, trial, and included benefits shown on the purchase screen at the time of purchase control over any general description in these Terms.

Puzzly Pro may include benefits such as removing completion advertisements, unlocking released archive puzzles, and allowing archive replays. Benefits may vary by product and App version.

Purchases are processed by Apple through your Apple Account. We do not receive your full payment-card details.

Auto-renewing subscriptions

If the product is described as an auto-renewing subscription:

• payment is charged to your Apple Account when you confirm the purchase;
• the subscription renews automatically for the same period unless you cancel it at least 24 hours before the end of the current period;
• Apple may charge your account for renewal within 24 hours before the current period ends;
• you can manage or cancel the subscription in your Apple Account subscription settings; and
• deleting the App does not cancel a subscription.

If a free or discounted trial is offered, any unused portion may be forfeited when you purchase a subscription where Apple’s rules permit. Unless applicable law requires otherwise, cancellation takes effect at the end of the current paid period.

Restoring purchases and refunds

You may use the App’s restore-purchases option, where available, for eligible purchases associated with your Apple Account. Apple controls billing, cancellation, and refund processing. Refund requests must be made to Apple, subject to Apple’s policies and applicable law.

5. Advertisements

The free version may display advertisements, including after puzzle completion. Advertising availability and frequency may change. A paid entitlement that promises to remove ads will remove the in-App advertising covered by that entitlement while the entitlement remains active.

Ads may link to the App Store or other third-party destinations. We do not control or endorse third-party products merely because an advertisement appears in the App.

6. Game Center and fair play

Game Center is optional and is provided by Apple under Apple’s own terms and privacy rules. If you connect Game Center, the App may submit your completion time to the leaderboard associated with the puzzle you completed and may display your Game Center name in the App.

Leaderboard rankings and availability are controlled in part by Apple. We may disregard, remove, or report scores that reasonably appear to result from cheating, manipulation, technical abuse, or a violation of these Terms.

7. Your feedback and submissions

You may choose to send ideas, bug reports, questions, comments, or other feedback. You retain ownership of your submission. You grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, adapt, publish, translate, and incorporate it into our products and services without compensation or attribution, to the extent permitted by law.

Do not include confidential information or content you do not have the right to share. An idea submitted through the feedback feature may be displayed on a public feedback board; bug reports, general feedback, and questions are intended to remain private. Please review the submission screen before sending anything.

8. Intellectual property

The App—including its software, designs, illustrations, puzzle content, text, graphics, branding, and other materials—is owned by or licensed to Waraira Tek LLC and is protected by intellectual-property laws. Except for the limited license in these Terms, no rights are transferred to you.

You may use the App’s built-in sharing tools to share the result summaries they generate for personal, non-commercial purposes, provided you do not misrepresent or alter them in a misleading way.

9. Privacy

The Privacy Policy above explains how information is handled when you use the App. By using the App, you acknowledge that you have read it.

10. Third-party services

The App relies on services supplied by third parties, including Apple, Game Center, RevenueCat, and GrowthCat. Those services may have separate terms and privacy policies. We are not responsible for third-party services, content, availability, or actions, except where applicable law provides otherwise.

11. Updates and availability

You may need a compatible device, internet access, and current App or operating-system software to use some features. Internet or carrier charges are your responsibility. We may release updates that fix defects, change functionality, or maintain compatibility and security. Some features may stop working if you do not install a required update.

12. Disclaimers

To the maximum extent permitted by law, the App is provided “as is” and “as available.” We do not promise that it will be uninterrupted, error-free, secure, or compatible with every device, or that puzzle content or leaderboard information will always be accurate or available.

Nothing in these Terms excludes warranties, remedies, or other rights that cannot lawfully be excluded, including mandatory consumer rights.

13. Limitation of liability

To the maximum extent permitted by law, Puzzly, its operator, and its contractors will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, profits, goodwill, or business opportunity arising from the App.

To the maximum extent permitted by law, our total aggregate liability relating to the App or these Terms will not exceed the greater of (a) the amount you paid for the App during the 12 months before the event giving rise to the claim or (b) USD 50.

These limitations do not apply to fraud, willful misconduct, death or personal injury caused by negligence, or any liability that applicable law does not permit us to limit.

14. Suspension and termination

You may stop using the App at any time. We may suspend or terminate access to online features if you materially or repeatedly violate these Terms, misuse a service, create a security risk, or if suspension is reasonably required by law or a platform provider.

Upon termination, the license granted to you ends. Sections that by their nature should survive—including intellectual property, disclaimers, liability limits, and dispute provisions—will survive. Termination does not automatically cancel an Apple subscription; you must cancel it through Apple.

15. Changes to these Terms

We may update these Terms to reflect changes to the App, law, security practices, or our business. We will change the effective date and, when required, provide additional notice. If a material change requires consent, we will request it. Continued use after an update becomes effective constitutes acceptance where permitted by law.

16. Governing law and disputes

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. Courts located in Spain will have jurisdiction, except that this provision does not deprive you of mandatory consumer protections or your right to bring a claim in another court where the law of your place of residence requires it.

Before filing a formal claim, please contact us and allow us a reasonable opportunity to resolve the issue informally.

17. Apple-specific terms

These Terms are between you and Waraira Tek LLC, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for it. Where applicable, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.

Your license is also subject to the Apple Media Services Terms and Conditions and Apple’s Standard Licensed Application End User License Agreement. If these Terms conflict with mandatory App Store terms, the mandatory App Store terms control.
